Job Description

Flynn Group (together with its subsidiaries Apple American Group, Bell American Group, Pan American Group, RB American Group, Hut American Group, Wend American Group, and Flynn Fitness Group) seeks an Associate General Counsel, Employment to lead the Company’s in-house Employment Litigation and Counseling practice. The role will report directly to the General Counsel.
In this position, you will oversee all employment litigation and counseling matters for the world’s largest franchise operator, with more than 2,600 restaurants and gyms, and over 75,000 employees across the U.S. and Australia. This is a unique opportunity to join a diverse and dynamic in-house legal department in a high-visibility, high-impact role with direct access to senior leadership. This is position is based in our San Francisco, CA Support Center.
Responsibilities
- Litigate! You will lead a team of employment litigators and legal professionals to manage the Company’s docket of employment-related matters/disputes. You and your team will handle your own litigation/arbitration matters from start to finish, as well as oversee and coordinate outside counsel litigation efforts. You will interview witnesses, take depositions, handle motion practice, engage in pre-trial dispute resolution, and first-chair arbitration and trial.
- Respond and oversee responses to agency charges, government audits, and demand letters.
- Communicate with and prepare required reporting to insurance carriers for covered claims.
- Serve as subject matter expert and provide advice and counseling across a broad spectrum of nationwide employment issues, including wage and hour, payroll, benefits, hiring, performance management, internal investigations, leaves of absence, discipline, terminations, employee classification, and employee privacy.
- Collaborate with Legal Compliance, HR, Payroll, Operations, Risk, and Training to provide guidance on appropriate updates to and implementation of policies and procedures based on changes in external laws, regulations, and case law developments.
- Devise processes and procedures to help support and scale a growing legal department and business, including managing in-house and outside counsel budgets and spend.
- Prepare reporting on trends in employment practice to inform and advise General Counsel and business partners of litigation results, trends, and opportunities.
- Supervise and develop practice group team members to execute on responsibilities and the department’s mission to provide exceptional service, superior results, and unmatched value.
- Continuously identify opportunities to increase efficiencies and favorable results; evaluate and prepare recommendations for appropriate resourcing to support the Company’s growth.

Key Qualifications
- 10+ years of employment law experience, including California wage and hour litigation.
- Juris Doctor from an accredited law school; must have California Bar admission in good standing.
- Experience leading all facets of employment litigation through trial/arbitration, as well as knowledge of federal and state employment laws and regulations (including Title VII, ADA, FMLA, FLSA, FEHA, PAGA) and federal and state agencies (DOL, EEOC, DLSE, DFEH).
- Experience with providing advice and counsel across multiple jurisdictions on a wide variety of employment-related issues.
- Experience with both class/collective/representative actions and single-plaintiff cases.
- Entrepreneurial mindset that enables you to work independently with little guidance, while using good judgment to escalate issues when needed.
- Demonstrated ability to guide multiple objectives and initiatives simultaneously.
- Ability to operate as a team player who can effectively work with and manage legal staff and collaborate with business partners across the company.

The good faith estimated range of pay for the above position for California-based candidates is $195,000-275,000 depending on factors including but not limited to experience and skill. There is a target discretionary incentive bonus of 20%.
